In consideration of your use of and access to this Internet site www.zolartek.com (collectively called the ” Site”), and the promises and obligations herein, and intending to be legally bound, you and Zolar Technology hereby agree as follows:
Your access to and use of the Zolar Technology Site is subject to these Terms, as well as any modifications issued by Zolar Technology & Mfg Co. Inc. to these Terms, and all applicable laws and regulations. BY USING THE ZOLAR TECH & MFG SITE, YOU AGREE TO AND WILL BE DEEMED TO BE BOUND BY THESE TERMS. If any of these terms or policies shall be deemed invalid, void, or for any reason unenforceable, that term or policy shall be deemed severable and shall not affect the validity and enforceability of any remaining term or policy.
Termination
These Terms are effective until terminated by Zolar Technology. Zolar Technology may terminate these Terms without notice and at any time. In the event of termination, you are no longer authorized to access the Site, and the restrictions imposed on you with respect to the Content, and the disclaimers, indemnities, and limitations of liabilities set forth in these Terms shall survive termination.
Zolar Technology shall also have the right without notice and at any time to terminate the Site or any portion thereof, or any products or services offered through the Site, or to terminate any individual’s right to access or use the Site or any portion thereof.
Compliance with Laws

Prices and Orders
Prices on the site are as per the currency indicated, but all international prices are in USD. Zolar Technology may restrict delivery to addresses where we are authorized to sell. Decision of Zolar Technology will be final in this regard. Zolar Technology will add shipping and handling fees and applicable sales/use tax. Zolar Technology reserves the right without prior notice to discontinue or change specifications and prices on products and services offered on the actsmedical without incurring any obligation to you. Products displayed on this site are available while supplies last. The receipt by you of an order confirmation does not constitute acceptance of an order by Zolar Technology. Prior to acceptance of an order by Zolar Technology, verification of information may be required. Zolar Technology reserves the right at any time after receipt of your order to accept or decline your order, or any portion thereof, even after your receipt of an order confirmation from Zolar Technology, for any reason. In the event that a product or service is listed at an incorrect price due to supplier pricing information or typographical error, Zolar Technology shall have the right to refuse or cancel orders placed for the product listed at the incorrect price, regardless of whether the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Zolar Technology shall promptly issue a credit to your credit card account in the amount of the incorrect price.
Risk of Loss
All items purchased from the Site are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Indemnification
You agree to defend, indemnify, and hold harmless Zolar Technology, Zolar Technology vendors, and their affiliates and related entities and their respective directors, officers, employees, and agents from and against all claims, losses, damages, liabilities, and costs (including but not limited to reasonable attorneys’ fees and court costs), arising out of or relating to your breach of these Terms or your access to or use of the Site. The foregoing indemnification obligation shall survive termination of these Terms and the Site and any product or service provided to you arising out of or relating to your use of the Site.
User Accounts
If you create a user account on the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. The Site does sell products for children, but it sells them to adults, who can purchase with a credit card. If you are under 18, you may use the Site only with involvement of a parent or guardian. Zolar Technology and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

Zolar Technology shall not be liable for any nonperformance or delay in performance caused by any act beyond its reasonable control, including but not limited to acts or omissions of third parties, unavailability of supplies, equipment failure, war, strikes, lock-outs, fire, flood, or any other Act of God, any law, regulation, ordinance, or other act or order of any court, government, or governmental agency, or delays, unavailability, errors, or other failures of the Internet or other data networks.
Access to or use of the Site shall not be construed as Zolar Technology purposeful availment of the privilege or benefits of doing business in any state or legal jurisdiction other than the Province of Ontario, Canada. This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflicts of law provisions. Additionally, any claims brought against Zolar Technology shall be governed by and construed in accordance with the laws of Ontario, Canada. Sole and exclusive jurisdiction for any action or proceeding arising out of, or related to, this Agreement, use of this website, or any orders placed or products purchased on Zolar Technology, shall be in the state or federal courts located in Ontario.
